GENERAL TERMS AND CONDITIONS – KLAARTJE JASPERS

1. Independence & Priority of Terms
1.1 The Creator performs the assignment as an independent contractor. No relationship of authority or employment exists. The Creator is free to execute the assignment according to their own professional judgment.
1.2 These terms shall supersede any (purchase) terms and conditions of the Client. Any deviations are only valid if explicitly confirmed in writing by the Creator for each specific assignment.
2. Licensing & Multimedia Exploitation
2.1 The Creator grants a non-exclusive license for a one-time publication/broadcast of the Contribution (text, image, audio, and/or video) in the agreed-upon Media Outlet.
2.2 Any reuse, syndication, distribution to third parties, or use in media formats other than those agreed upon is excluded and requires prior written consent and an additional licensing fee.
2.3 Exclusivity is strictly limited to 24 hours following the first publication, unless otherwise agreed upon in writing.
3. AI Restriction & Moral Rights (AI Opt-Out)
3.1 AI Opt-Out: In accordance with the EU AI Act and international standards, the Client and any third parties are expressly prohibited from using the Contribution for the training, feeding, or exploitation by (generative) artificial intelligence (AI) systems or automated analysis techniques (text and data mining).
3.2 The Creator reserves all moral rights under the Berne Convention. Any substantive changes to the Contribution (editing, headlines, or context) require prior approval to ensure the integrity of the work.
4. Full Indemnification & Safety
4.1 The Client bears the full risk of publication. The Client shall fully indemnify and hold the Creator harmless against all third-party claims (e.g., from governments or corporations) and cover all legal defense costs (protection against SLAPPs). This indemnification remains in effect after the assignment is completed.
4.2 The Creator operates in accordance with the IFJ Global Charter of Ethics. Any alleged breach thereof by the Creator shall never suspend the Client’s obligation to pay.
4.3 For assignments in high-risk areas or during protests, the Client acknowledges a duty of care toward the Creator.
5. Governing Law & Language
5.1 These terms are governed by Dutch law. In the event of any conflict or inconsistency between the Dutch text of these terms and this translation, the Dutch version shall prevail.
